EU Authorized Representative for Products under the EMC Directive (2014/30/EU)

The Electromagnetic Compatibility (EMC) Directive 2014/30/EU applies to electrical and electronic products that may generate or be affected by electromagnetic disturbance.

Non-EU manufacturers placing EMC Directive-regulated products on the EU market must appoint an EU-based Authorized Representative to support documentation access and authority communication. EARP acts as an independent EU Authorized Representative for manufacturers that are required or choose to appoint an EU-based representative under the EMC Directive, ensuring your formal EU representation obligations are met.

Scope of the EMC Directive

Ensuring Electromagnetic Safety and Performance

The EMC Directive ensures that electrical and electronic equipment does not generate electromagnetic disturbances that interfere with other devices and that it remains immune to external electromagnetic interference during normal operation. The EMC Directive applies to a wide range of electrical and electronic equipment, including but not limited to:

  • Consumer electronics
  • Household appliances
  • Smart home devices
  • Wireless communication products
  • Power supplies and adapters

Manufacturers placing products on the EU market must prepare and maintain a technical documentation file demonstrating compliance with the EMC Directive. This documentation must be made available to EU Market Surveillance Authorities upon request.

Frequent Compliance Issues and Related Compliance Risks

Electromagnetic compatibility issues can result in market withdrawals when products cause interference or cannot operate reliably in the presence of electromagnetic disturbances.

Excessive Electromagnetic Emissions

Devices emitting electromagnetic disturbances above permitted limits may interfere with radios, communication systems, or nearby electronics.

Insufficient Immunity to Interference

Products may malfunction when exposed to electromagnetic disturbances from other devices or environmental sources.

Incomplete EMC Testing

Manufacturers sometimes rely on partial or outdated laboratory tests that do not reflect the final product configuration.

Inconsistent Technical Documentation

Technical files may lack the required EMC test reports, circuit descriptions, or component specifications necessary to demonstrate conformity.

Design Changes After Testing

Modifications to power supplies, internal components, or shielding may invalidate previously completed EMC tests.

The Role of the Authorized Representative under EMC

Under the EMC Directive, the Authorized Representative acts on behalf of the manufacturer for clearly defined legal tasks. These tasks are focused on documentation availability, traceability, and cooperation with EU authorities. The Authorized Representative must be able to:

Documentation & EU DoC Access

Make technical documentation and the EU Declaration of Conformity available upon request.

Corrective Action Support

Support corrective actions when non-compliance is identified.

Authority Communication & Cooperation

Cooperate with market surveillance authorities when needed.

EARP’s Role as Authorized Representative

As your appointed Authorized Representative, EARP acts as your formal regulatory contact with EU Market Surveillance Authorities. We ensure that your company fulfills the administrative and communication duties required under the EMC Directive. Our role includes:

Being identified on product labeling or packaging as your EU contact

Forwarding authority requests and supporting responses to compliance inquiries

Holding and providing Declarations of Conformity and technical documentation upon request

Cooperating with EU authorities in case of safety or interference-related investigations

Maintaining documentation access for the legally required period

EARP operates as an independent Authorized Representative and does not participate in the import, distribution, or commercial sale of products. This independent structure avoids conflicts of interest and ensures that regulatory communications remain focused on compliance obligations.
