EU Based Authorized Representative & Responsible Person Services

The General Product Safety Regulation (EU) 2023/988 (GPSR) requires non-EU manufacturers to designate an EU-based Responsible Person (RP) before consumer products can be sold to EU consumers. This requirement is set out in Article 16 of the GPSR and applies to products sold both online and offline.

The Role of the AR/RP

Under the GPSR, the RP is the EU economic operator designated to support product safety enforcement and traceability. This role exists to ensure that EU authorities always have a reliable contact who can provide documentation, product information, and cooperation when safety issues arise. The RP may be an EU manufacturer, an EU importer, an authorized representative with a written mandate, or in specific cases, a fulfilment service provider.

When no importer is involved, such as in distance sales or online marketplace models, appointing an authorized representative as Responsible Person is the most predictable solution.

Keep in mind that the Responsible Person does not replace the manufacturer’s responsibility for product safety, but ensures that safety obligations can be enforced effectively within the EU.
